Gurgaon – In a significant development, Gurgaon police have filed a closure report and cancelled an FIR lodged against a relative of a medical negligence victim, stating the allegations were found to be false and malicious. This marks a pivotal moment in the ongoing pursuit of justice for Simran Chhabra, who died on January 21, 2023, at Jagdamba Hospital in Jyoti Park, Gurgaon, amid allegations of medical negligence.
Incident and Initial Allegations
Simran Chhabra, a 22-year-old resident of Jyoti Park, was admitted to Jagdamba Hospital on January 21 with complaints of stomach ache and tragically passed away within a few hours. “She had arrived at the hospital on her scooter and did not have any prior history of illness,” said Advocate Nishant Bharihoke, representing the Chhabra family.
False FIR Filed by Doctor
Following the family’s pursuit of the case, Dr. Rohit Lalit, the doctor accused of negligence, filed an FIR on April 11, 2023, accusing the deceased’s family of trespassing, intimidation, and causing hurt. This move was perceived by the family and their legal counsel as an attempt to intimidate them and deter their fight for justice.
Police Investigation and Closure Report
The crime branch of Gurgaon police investigated Dr. Lalit’s allegations and found them to be baseless. Consequently, a closure report was submitted to Judicial Magistrate First Class (JMFC) Anil Kumar Yadav earlier this week. “The false FIR was an attempt to intimidate the bereaved family amid their pursuit of justice,” stated Advocate Bharihoke.
Strengthening the Case Against Medical Negligence
With the police filing a closure report and cancelling the FIR, the Chhabra family’s case against Dr. Lalit is further strengthened. “Our case against the doctor is bolstered, aiding our fight for justice for Simran Chhabra,” said Bharihoke. Additionally, Dr. Lalit is facing criminal charges for allegedly assaulting the family’s advocate on August 27, 2023, under FIR No. 173/2023 at Police Station New Colony, Gurgaon.
Call for Stricter Regulations
Advocate Bharihoke emphasized the need for stricter regulations to prevent such incidents, highlighting the critical importance of transparency and integrity in the medical field. “The case underscores the necessity for stringent measures to ensure accountability and uphold the trust in healthcare professionals,” he added.
Judicial Consideration
The court will consider the closure report on July 23, 2024. This development brings hope for the Chhabra family and advocates fighting against medical negligence and false accusations.
Conclusion
This case highlights the ongoing challenges faced by victims of medical negligence and their families. The exposure of the false FIR serves as a reminder of the importance of integrity in the medical profession and the justice system. As the court prepares to review the closure report, the community stands with the Chhabra family in their quest for justice.
