Gurgaon, July 3, 2024 — A case of cheating has been registered against the directors of Emaar India after allegations surfaced that a plot designated as a green belt was sold to a developer for building a school. The complaint was lodged by Polestar Private Ltd at Sector 65 police station around a month ago.
Background of the Complaint
Polestar Private Ltd, through its director DK Sharma, reported that Emaar India approached them with an offer to sell a 1.2-acre plot in Heritage One society in Sector 62, Gurugram. Emaar allegedly represented that the plot was approved by the town and country planning department in Chandigarh for use as a primary school.
Sharma stated that Polestar Pvt Ltd paid Rs 8.1 crore for the plot based on these representations. However, when Polestar submitted its layout for a primary school to the DTCP in January, they discovered that the land was actually a designated green belt.
Details of the Alleged Misrepresentation
According to Sharma, Emaar provided several documents, including a licence dated May 14, 2010, issued by the DTCP Chandigarh, and an approved site plan of the colony showing the plot’s location. They also shared a request for an extension of time until May 13, 2025, which was submitted to the DTCP Chandigarh on April 8, 2022.
However, Sharma alleged that on May 6, Amit Chhabra from Emaar sent a copy of the site plan indicating that the plot sold was actually approved as a green area. “We went ahead with the deal following Emaar’s representations about the land. They said they had been paying the requisite licence fee, which was paid until April 8, 2022. After receiving the possession letter of the plot, we incurred an additional loss of Rs 57 lakh towards stamp duty payable on the conveyance deed,” Sharma wrote in his complaint.
Legal Actions and Accusations
In an email received on May 1, Emaar allegedly admitted their culpability but attempted to shift the blame onto other contractors and developers, framing the issue as a ‘civil dispute.’ They also started questioning the motives of Polestar for raising the issue of being cheated.
An FIR has been lodged against Mohamed Ali Rashed Alabbar, the director of Emaar India, under IPC sections 420 (cheating) and 120B (criminal conspiracy).
Call for Action
Sharma expressed concern that the accused might flee the country, considering Emaar is an international company. “We request the police to seize their passports and issue a lookout notice until the investigation is complete,” he said on Tuesday.
Sandeep Kumar, a spokesperson for Gurgaon police, stated, “We will be calling them for revenue records from the DTCP in Chandigarh. The case will be probed in keeping with the rules.”
