Delhi Court Summons Dhruv Rathee in Defamation Case Filed by BJP’s Suresh Nakhua

New Delhi, July 25, 2024 – A Delhi court has issued summons to YouTuber Dhruv Rathee and two others in a civil defamation case filed by Suresh Nakhua, the BJP Mumbai unit spokesperson. The case pertains to Rathee allegedly referring to Nakhua as part of “violent and abusive trolls” in a video.

Court Proceedings: District Judge Gunjan Gupta, in an order passed on July 19, stated, “Issue summons of the suit and notice of the application u/o 39 Rule 1 and 2 CPC to the defendants, subject to steps by all modes i.e. PF & RC/Speed Post/ Approved Courier including electronic mode for 06.08.2024.”

Details of the Case: Nakhua’s suit against Rathee, Google LLC, and X Corp (formerly known as Twitter) alleges that on July 7, Rathee uploaded a video titled “My Reply to Godi Youtubers | Elvish Yadav | Dhruv Rathee,” in which he referred to Nakhua as a part of violent and abusive trolls without reason, aiming to tarnish his reputation.

Nakhua claims the video was a deliberate attempt to besmirch his integrity and reputation through baseless accusations and malicious connections. He further contends that Rathee’s defamatory statements have caused irreparable harm to his personal and professional life.

Legal Actions and Demands: Nakhua has sought a permanent injunction against Rathee, restraining him from posting, tweeting, publishing, creating, or sharing any derogatory and harmful material about him or the BJP on any platform. Additionally, Nakhua has requested a decree of damages amounting to ₹20,00,000 for the defamation caused to him.

Nakhua also requested a permanent injunction against Rathee, preventing any form of contact with him or his colleagues.

Next Steps: Dhruv Rathee is required to appear before the court on August 6, 2024, to address the defamation allegations. The proceedings will be closely watched, as they may set a precedent for similar cases involving online defamation and social media content.
