Kolkata, India: In a dramatic turn of events in the Kolkata rape-murder case that has shocked the nation, advocate Kabita Sarkar, the court-appointed lawyer for the accused, Sanjay Roy, has come forward to assert her client’s innocence. Sanjay Roy, who is currently in judicial custody, stands accused of raping and murdering a 31-year-old postgraduate trainee doctor at the RG Kar Medical College and Hospital on August 9.
Speaking to India Today TV, Kabita Sarkar revealed that her client is under immense mental pressure due to the severe accusations leveled against him. Despite this, Roy is reportedly eager to undergo a polygraph test, commonly known as a lie detector test, to prove his innocence. “My client Sanjay Roy wants the officials to conduct a polygraph test on him as it will bring the truth out,” Sarkar stated. “He is innocent and is eager for the polygraph test to clear his name.”
Sarkar, who was appointed by the Sealdah court to defend Roy after no other lawyer was willing to take the case, emphasized that Roy had willingly consented to the polygraph test. “I was present when Sanjay’s consent was taken for the polygraph test,” Sarkar explained. “He gave his consent willingly, and I personally took the time to explain to him what the test entails. He agreed because, according to him, he’s under immense mental pressure due to the accusations, but he believes that the test will ultimately reveal the truth.”
Sanjay Roy’s case has garnered significant attention, not only because of the gruesome nature of the crime but also due to the legal and ethical complexities surrounding his defense. Sarkar, standing firm in her role, asserted that her client is not involved in the crime for which he is being investigated. “Sanjay is prepared to undergo any tests necessary and is committed to assisting in every possible way to ensure that the real perpetrator is identified,” the senior lawyer added.
The Central Bureau of Investigation (CBI), which is handling the investigation, had sought permission to conduct the polygraph test on Roy, a request that was granted by a Kolkata court after Roy consented to the procedure. The polygraph test is seen as a crucial step in the investigation, which continues to unfold under intense public scrutiny.
Division in Legal Community
The decision by Kabita Sarkar to represent Sanjay Roy has sparked a wave of controversy within the legal community. While her right to choose her cases is acknowledged, many of her colleagues have expressed strong opposition to her defending someone accused of such a heinous crime.
“We respect her freedom to choose her cases,” said one of the protesting lawyers, “but we vehemently oppose her decision to represent someone accused of such a heinous crime. What he has done is beyond terrible. Our stand is firm—justice must be served, and we demand exemplary punishment for the accused.”
As the legal battle continues, the city of Kolkata—and indeed the nation—waits to see whether the polygraph test will bring clarity to a case that has left many in shock and disbelief.
