Calcutta High Court Criticizes State Police for Failing to Prevent Vandalism at RG Kar Medical College, Hands Over Probe to CBI

Kolkata: The Calcutta High Court on Friday strongly criticized the West Bengal state police for their failure to anticipate and prevent the vandalism at RG Kar Medical College and Hospital following protests over the rape and murder of a 31-year-old postgraduate student. The court expressed disbelief that the police were unaware of the potential for violence and termed the incident an “absolute failure of state machinery.”

Court’s Strong Remarks and Questions

During the hearing, the division bench, led by Chief Justice T.S. Sivagnanam and Justice Hiranmay Bhattacharyya, questioned why prohibitory orders under Section 144 of the CrPC were not imposed within a kilometer radius of the hospital, given the tense situation. “Could this vandalism have been prevented is the question. Who did it comes later,” the court remarked, highlighting the lack of preventive measures by the authorities.

The court also expressed concern over the ongoing work near the seminar hall where the August 9 rape-murder took place. The victim’s parents had alleged that the crime scene was compromised due to construction work. The High Court directed the authorities to submit a detailed report with photographs to prove that the crime scene remains intact.

Investigation Transferred to CBI

The Calcutta High Court has ordered the police to transfer the investigation into the rape-murder case to the Central Bureau of Investigation (CBI). The decision was made earlier this week, following the court’s dissatisfaction with the handling of the case by the state police.

The court has directed the police to submit a comprehensive sequence of events leading up to the vandalism, emphasizing the need for transparency and accountability. “Something is required to inspire our confidence,” Chief Justice Sivagnanam stated, referencing the need for clarity on how a 7,000-strong mob was able to breach barricades and wreak havoc within the hospital premises.

The bench emphasized that adequate protection must be provided to the doctors so they can continue to fulfill their duties.
