Dehradun Man Acquitted After Five Years in Jail Over False Rape Allegation by Daughter

Dehradun, Uttarakhand: In a significant judgment, the additional district judge of a special Pocso court in Dehradun has acquitted a 42-year-old man who had spent the last five years in jail after being falsely accused of raping his 15-year-old daughter. The court’s decision came after a thorough examination of evidence and witness testimonies, which revealed that the accusation was fabricated.

The case, registered on December 25, 2019, was based on a complaint filed by the Child Welfare Committee (CWC). The complaint stated that the girl had accused her father of sexual abuse, a claim supported by her younger sister. The man, a laundryman in Dehradun, was arrested and sent to jail on December 27 of the same year.

During the investigation, police recovered letters written by the girl to her boyfriend. Under cross-examination, the girl confessed that she had been in a relationship with a boy who had instigated her to lodge a false complaint against her father with the CWC. The girl admitted that she was upset with her father for disapproving of her relationship and for objecting to her skipping school.

Moreover, the doctor who examined the girl informed the court that her medical reports were negative and could not confirm any sexual abuse. After reviewing all the evidence, the court declared the man innocent, issuing an acquittal order last week.

The case highlights the severe consequences of false accusations and the importance of thorough investigation and judicial scrutiny. The man’s acquittal brings some relief after years of unjust imprisonment, but it also raises concerns about the emotional and social impact of the false allegation on the entire family.
